RULES AND REGULATIONS OF MAGADH FOUNDATION

1) The Name of the Organisation :

Magadh Foundation

a) Head Office: Magadh foundation, Saket, New Delhi

b) Registered office, Magadh foundation, Jorkat palamu jharkhand

2) Definitions & Interpretations:

Unless it is inconsistent with the subject or context in which it is used:

i) “Act” shall mean both Rules made there under as amended from time to time.

ii) “Person” means a living person who has attained the age of maturity and is of sound mind.

iii) ‘’Member’’ means a member of the Magadh Foundation.

Explanation: No registered or unregistered Firm or Company or a body corporate shall be eligible to become member of the Magadh Foundation.

iv) ‘’President’’ means President of the Magadh foundation is president of all the committee of the Magadh Foundation.

v) ‘’Central Committee’’ means the apex committee of the Magadh Foundation consisting of the President and Elected 11 members by national working committee to formulate the policies and programmes to achieve the aims and objectives of the Magadh Foundation.

vi) Magadh Executive Committee’’ means the committee elected by the Block heads from each district of India to manage the bigger policy affairs of the Magadh Foundation and implement the policies and programmes approved by the Central Committee and take any other action to achieve the aims and objectives of the Magadh Foundation.

viii) ‘’Block Head’’ means head of the block elected by the panchayat heads in the concerned block.

Explanation:

a) A village may consist of a single or two or more villages as decided by the District Head of the Magadh Foundation.

b) Where the village is large in area or thickly populated, there can be more than one village head as may be decided by the President.

ix) ‘’Panchayat Head’’ mean head of the Panchayat elected by the members of village head of the Magadh Foundation in the concerned Panchayat.

x) ‘’Village Head’’ mean head of the Village elected by the members of village of the Magadh Foundation in the concerned village.

Explanation: A village may consist of a single or two or more villages as decided by the District Head of the concerned district.

xi) ‘’Chief Executive Officer’’ means the senior most officer appointed by the President to look after the day to day work of the Magadh Foundation.

3) Membership:

i) The membership of the Magadh Foundation shall be open to any person who has attained the majority age and subscribes to the aims and objectives of the Magadh Foundation, fulfils such other qualifications may be prescribed by the Executive Committee from time to time and pay the admission fee.

ii) The admission to the Magadh Foundation shall be subject to the approval of the Screening Committee to be constituted by the President.

iii) The Executive Committee shall prescribe the procedure from time to time for consideration of applications for membership of Magadh Foundation.

iv) Membership shall not be transferable. However, it shall be transferable to the legal heir of a deceased member.

v) The admission to membership of the Magadh Foundation shall stand closed from the date of issuance of the list of members prior to holding the elections to the district / block / village / panchayat heads. The free as to lots.

4) Admission Fee and Annual Subscription Fee

i) The admission fee and annual subscription fee and other contributions payable by members of the Magadh Foundation shall be fixed or revised or further revised, as decided by the Executive Committee from time to time.

ii) All members shall pay the annual subscription and other contributions within the stipulated time as decided by the Executive Committee failing which the defaulting members shall be liable to pay simple interest at the rate decided by the Executive Committee.

iii) The Executive Committee shall always have the power to re-schedule, reduce or write-off any dues from a member for reasons to be recorded in writing.

iv) The membership fee of members Centrale committee RS 11000/-

v) The membership fee of members Executive committee RS 1100/-

vi) The membership fee of members District committee RS 1100/-

vii) The membership fee of members Block committee RS 100/-

viii) The membership fee of members Panchayat committee RS 100/-

ix)The membership fee of members village committee RS 100/-

5) Termination or cessation of membership:

A member shall cease to be a member of the Magadh Foundation in the following circumstances:

i) On acceptance of his resignation.

ii) The President, Suo- motto or on recommendation of the district or village or village heads, shall have the powers to expel or terminate or suspend a member from the primary membership of the Magadh foundation on the following grounds.

  • (a) On being found guilty of acting against the aims and objects, interests, plans and programmers of the Magadh Foundation.
  • (b) On being found to be involved in any anti-social activities.
  • (c) On being adjudged by any court of law as guilty of moral turpitude.
  • (d) On being adjudged as insolvent.
  • (e) On failure to pay the subscription or any other contribution demanded by the Foundation from the members for a period of two years.
  • (f) On being held as a person of unsound mind.
  • (g) On being found of not behaving as a normal person.
  • (h) On any other ground which in the opinion of the President it is not in the interest of the Magadh Foundation to retain the member.

iii) The President may give the concerned member a reasonable opportunity to explain his position, if he considers it appropriate before expelling or terminating his membership.

iv) Pending receipt of reply from the concerned person and decision thereon, the President may place him under suspension.

v) The decision of the President regarding imposing suspension or revoking suspension or expulsion or termination shall be final.

vi) On termination or cessation, the admission fee, annual subscription fee or any other contribution made by the concerned member shall not be refundable under any circumstances.

6) Central Committee:

i) The general supervision, management and control of the Foundation shall vest with the Central Committee.

ii) The annual budget of the Foundation shall be prepared by the Central Committee.

iii) The Central Committee shall have the power to borrow, from time to time, such amount as it may deem necessary and at such terms and conditions it might find acceptable.

iv) The Central- Committee shall be responsible for making arrangements for organizing the meetings of Executive Committee and to appoint Election Officer to elect members of the Central Committee.

v) The Central Committee shall fix / revise the admission fee, annual subscription and other contributions to the Foundation or plan for additional resources.

vi) The Central Committee shall have all powers to take any decision whether administrative or financial or legal to achieve the objectives mentioned in the memorandum of association.

vii) To appoint Auditors to audit accounts of the Foundation. Only chartered accountants or firms of chartered accountants holding a valid certificate of practice issued by the Institute of Chartered Accountants of India shall be eligible for appointment as auditor of the Foundation.

viii)The general supervision, management and control of the Foundation shall vest with the Central Committee.

ix) The annual budget of the Foundation shall be prepared by the Central Committee.

x) The Central Committee shall have the power to borrow, from time to time, such amount as it may deem necessary and at such terms and conditions it might find acceptable.

xi) The Central Committee shall approve the staff strength of the society and their service conditions and be authorized to appoint any office bearer/executive member or any other person to look after any particular function or activity.

  • a. Term: -The term of every Central Committee shall be 02 years. A member of the Central Committee shall be eligible for re-election.
  • b. Notice: - Minimum 07 days’ notice shall be required for convening the Meeting of Central Committee. Dispatch of notices by post or email or WhatsApp or through any electronic means shall be considered to be valid dispatch of notice.
  • c. Quorum: - Quorum of every Central Committee Meeting shall be 1/3rd of the total strength of the Central Committee at the time of convening the meeting.
  • d. Urgent Meeting: -The Urgent meeting of the Central Committee may be called at 24-hour notice but quorum should be complete at such meeting.
    • i. No proxy is permitted. If any member is unable to attend the meeting for whatsoever reason, he should seek leave of absence in advance by communicating with the President or the Chief Executive Officer.
    • ii. The Central Committee Members except the Special Invitees shall not be entitled to any remuneration or reimbursement of expenses to attend the meetings.
    • iii.Special Invitee, if any invited to attend the meeting may be paid travelling, boarding and lodging expenses for attending the meetings if so, decided by the President.
    • iv. If the President is not present at the time appointed for holding the meeting, or is unable to attend and act as the President of the meeting, any member of the central committee can chair the meeting who is the directed by president.
    • v. From in case a vacancy arises in the Central Committee for any reason, the same shall be filled from Executive Committee from time to time by president.

7) Functions and Powers of the Central Committee:

i) The Central Committee shall be the highest policy and programme and Rules making body of the Magadh Foundation.

ii) The annual budget of the Foundation shall be presented to the Central Committee.

iii) The decision on all financial and non-financial matters shall be with a simple majority of the members present.

iv) A majority of two third of members of the members shall be necessary to consider amendments to the Rules and Regulation of the Foundation in central committee.

8) Powers and functions of the President:

i) The President shall be shall head the Magadh Foundation.

ii) He shall assign duties and responsibilities to the members of the central and executive Committee as considered appropriate.

iii) He shall chair of the meetings of the Central Committee and Executive Committee and conducts their meetings in an orderly manner.

iv) He or his nominee shall represent the Foundation in meetings with the Central / State Governments, semi-Government and local authorities and meeting with Governments of other countries and international meetings.

v) He shall be the link between the Central Committee and the Executive Committee and shall communicate all decisions of the Executive Committee to the Central Committee.

vi) He shall undertake all such acts or omissions which he considers appropriate in the interest of the Foundation.

vii) All district heads shall work under the supervision and control of the President.

viii)The President shall appoint the Chief Executive Officer and entrust him with such duties and responsibilities he considers appropriate.

ix) The President shall cause the minutes of the meetings of Central and Executive Committee written as soon as possible after conclusion the meetings. The minutes as authenticated by the President shall be considered as authentic record of the proceedings of the meeting.

9) Executive Committee:

i) The executive Committee shall elect an central Committee of not exceeding 11 members to manage the day-to-day affairs of the Magadh Foundation and implement the policies and programmes approved by the Central Committee and take any other action to achieve the aims and objectives of the Magadh Foundation.

Explanation: The Central Committee may increase or decrease the strength of the Executive Committee from time to time as considered appropriate by the resolution in executive Committee.

ii) Meeting: - The meetings of the Executive committee shall be held at least once in a year unless prevented by a natural calamity, war, civil commotion or any other event, in which case the meeting shall be convened soon after normalcy gets restored. All decisions shall be taken by simple majority. In the event of equality of votes, the President of the Central Committee shall have a casting vote.

iii) The allotment of the work of central Committee shall be made in the meeting of executive committee as under:

  • i) one member in charge of membership south.
  • ii) one member in charge of membership north.
  • iii)one member in charge of membership east. iv)one member in charge of membership west. v) one member in charge of membership central. vi)one member in charge of mass communication.
  • vii)one member in charge of membership of Magadh sovereignty affairs.
  • viii)one member in charge of spiritual affairs.
  • ix) one member in charge of training program.
  • x) one member in charge of finance affairs.
    • a) President : One
    • b) General Secretary : One
    • c) Treasurer : One
    • d) Members : Eight

iv) If any office bearer resigns or dies or his membership is terminated or he relinquish his office for any reason, the President may appoint any member of the Central Committee in his place subject to confirmation of the executive Committee in its next seating.

v) Functions & Powers of Executive Committee:

The Executive Committee shall be entitled to exercise all the powers mentioned in the Memorandum of the Society and in these Rules and Regulations.

vi) All the higher policy decision taken by central committee should be approved in annual meeting of Executive committee.
